Draft — pending legal review. This page is a working draft prepared for review by TwoTide’s lawyers. It is not yet in force and will change before launch. Highlighted text marks points that counsel still has to decide.

The short version

  • TwoTide is for adults (18+) who want a serious relationship. Everyone is verified and reviewed by a person before they can join, and we can say no.
  • The $9.99 application fee is non-refundable. Memberships renew automatically until you cancel. Your first web billing cycle has a 14-day money-back guarantee.
  • Follow the Community Guidelines. Never ask another member for money. Breaking the rules can lead to a permanent ban tied to your verified identity.
  • Live streams are recorded and kept for 30 days. Video calls are never recorded. Tokens have no cash value.
  • We verify identity, but we don’t run criminal background checks and can’t guarantee how anyone will behave. Meet safely.

1. About these terms

These Terms of Membership are an agreement between you and Counsel to confirm: legal entity name, state of formation and registered address (“TwoTide”, “we”, “us”). They cover the TwoTide website at twotide.com, our iPhone and Android apps, TwoTide Live, and everything else we offer (together, the “Service”).

By applying for or using TwoTide you agree to these terms, to our Community Guidelines, which form part of these terms, and you acknowledge our Privacy Policy, which explains how we handle your information. If you don’t agree, please don’t use the Service.

TwoTide is currently in private preview: access needs an invitation code, some features run in test mode, and demo profiles may appear. We’ll tell you before any feature moves from test mode to real payments.

2. Who can join

To apply for and keep a TwoTide membership, you must:

  • be at least 18 years old. We confirm your age from your government ID, and we don’t accept anyone under 18, for any reason;
  • be able to form a binding contract, and not be barred from using the Service under the laws that apply to you;
  • apply as yourself, with your real name, date of birth, photos and details. No one may apply for or run an account on someone else’s behalf;
  • have only one TwoTide account. A social account, phone number or identity can belong to only one member;
  • not have been banned from TwoTide before;
  • not be required to register as a sex offender in any jurisdiction, and not have been convicted of a violent or sexual crime. Counsel to confirm: whether to keep this criterion, its exact wording, and how it interacts with fair-chance laws in our launch states

We’re accepting applications in New York & Miami first. We may limit membership to people living in or visiting the places where we operate.

3. Applying and verification

Membership is by application. To apply, you’ll:

  1. confirm your phone number and your email address with one-time codes;
  2. connect at least three of your social accounts (from Facebook, Instagram, TikTok and X) by signing in with each platform. We never post on your behalf;
  3. verify a government-issued photo ID with our identity-verification partner, including a live face match against your ID photo;
  4. record a short video selfie following randomly chosen gestures;
  5. pay the $9.99 application fee.

A member of our team then reviews your application. We decide who becomes a member, and we can decline any application, including one that passes every automated check. We don’t always give a reason, except where the law requires us to.

Verification continues after you join. We ask members to repeat the video selfie every 6 months, and may ask for it again at any time if something doesn’t look right. If you don’t complete it, we may hide your profile or pause your account until you do.

You agree that everything you give us is true and current, and to update it if it changes.

4. Your account and signing in

TwoTide doesn’t use passwords. You sign in with a six-digit code we email to you from [email protected]. Keep your email account secure, and never share a sign-in code with anyone. TwoTide staff will never ask you for one.

You’re responsible for what happens on your account. If you think someone else has access to it, tell us straight away at [email protected].

5. Fees, subscriptions and refunds

Application fee

The one-time application fee is $9.99. It covers the cost of verifying you and discourages throwaway applications. It is non-refundable, including if your application is declined, except where the law requires a refund. Counsel to confirm: whether any launch state requires refunding the fee when an application is declined

Membership plans

Once approved, you choose a plan. Current prices, in US dollars:

Membership prices
PlanMonthlyAnnual
Verified$29 a month$199 a year
Premier$79 a month$499 a year
Elite$199 a monthNot offered

What each plan includes is described on our pricing page. Prices and features can change. If a price change affects you, we’ll tell you in advance, and it applies from your next renewal.

Automatic renewal

Your membership renews automatically at the end of each billing period (monthly or yearly) and we charge the payment method on file at the price then in effect, until you cancel. We’ll remind you before an annual plan renews.

Counsel to confirm: auto-renewal disclosures and reminder timing required by New York, Florida and California automatic-renewal laws, and the checkout consent wording

Cancelling

You can cancel at any time from Settings → Membership plan (or, if you subscribed through Apple or Google, from your app-store account). Cancelling stops the next renewal; you keep access until the end of the period you’ve paid for. Apart from the money-back guarantee below, we don’t refund partial periods, except where the law requires it.

14-day money-back guarantee

If you bought your membership on twotide.com, you can ask for a full refund of your first billing cycle within 14 days of that first payment. It applies once per member, to the first membership payment only. It doesn’t cover the application fee, tokens, event tickets or later renewals. Email [email protected] to use it; your membership ends when the refund is issued.

App-store purchases

Purchases made through Apple’s App Store or Google Play are billed by Apple or Google, and refunds for them are handled by Apple or Google under their own policies. We can’t issue those refunds ourselves.

Payments and taxes

Web payments are processed by our payment provider; we don’t store your full card number. Prices don’t include taxes unless we say so, and you’re responsible for any that apply. If a payment fails, we may pause paid features until it succeeds.

Counsel to confirm: whether New York or Florida dating-service laws (for example NY General Business Law § 394-c) give members additional cancellation rights or fee limits that must appear here

6. Your conduct

You agree to follow our Community Guidelines, which are part of these terms. In particular, you must not:

  • ask another member for money, gifts, cryptocurrency, investments or financial help of any kind;
  • misrepresent who you are, use someone else’s photos, or create more than one account;
  • harass, threaten, demean or discriminate against anyone, or share sexual content without consent;
  • use TwoTide to sell or advertise anything, recruit, solicit, or offer or seek paid companionship or sexual services;
  • involve, depict or endanger anyone under 18;
  • get around our safety tools, for example by disguising links or contact details, or by coming back after a ban;
  • scrape, copy or collect data from the Service, use bots or automated access, or probe, disrupt or reverse-engineer it;
  • break the law, or help someone else do so.

How you treat people you meet through TwoTide, on or off the Service, can affect your membership. We may act on conduct off TwoTide when it puts members at risk.

7. Safety tools and enforcement

To keep members safe, we use automated tools and a human Trust & Safety team. You agree that we may:

  • screen messages automatically for signs of romance scams, such as requests for money, investment pitches or pushes to move to another app, and show a warning to the person receiving them;
  • hold back links in chat until two members have been matched for 7 days and exchanged 50 messages;
  • review profiles, photos, messages and reports when there’s a safety concern, a report, or a legal need;
  • remove content that breaks these terms or the Community Guidelines.

What we can do when rules are broken

Depending on how serious it is, we may:

  • send you a warning;
  • limit features, or hide your profile;
  • suspend your account while we investigate. You’ll be signed out, others won’t see you, and we’ll email you within 24 hours;
  • permanently ban you. Bans are tied to your verified identity, not just your email or phone number, so a banned person can’t apply again.

Money requests

The first time you ask a member for money, the message is flagged, the recipient is warned, and you receive a formal warning. The second time, the message isn’t delivered and your account is suspended immediately for review by a person, which normally ends in a permanent ban.

Reports

If three different members report you independently, your account may be suspended automatically until a person reviews it. On Live, nudity or harassment leads to an immediate permanent ban on the first offence.

If you think we got a decision wrong, email [email protected] and a different member of the team will look at it. Counsel to confirm: whether bans for money requests or Live one-strike offences can be appealed (the Safety center currently says “no appeal”)

If your membership is ended for breaking these terms, you won’t receive a refund of fees, membership or tokens, except where the law requires it.

8. Live, date rooms, tokens and gifts

Taking part in Live

TwoTide Live includes hosted events, member streams and short 8-minute video date rooms. Only fully verified members can go live. Hosted events always have a moderator. Anyone on a stream can use the report button, and hosts have a kill switch that ends the stream; a person on our team responds within 15 minutes.

Live streams are recorded. We keep recordings for 30 days so we can review reports and resolve disputes, and then delete them, unless we need to keep a recording longer for a specific safety investigation or legal reason. By hosting, joining or speaking on a stream you agree to it being recorded.

Counsel to confirm: recording-consent requirements, including all-party-consent states such as Florida, and whether date rooms are recorded like streams

Event tickets

Some events need a ticket ($9.99 to $29.99) on top of your membership. If we cancel a ticketed event, we’ll refund the ticket. Counsel to confirm: refund rules when a member can’t attend or an event is cut short

Tokens

You can buy tokens in bundles ($4.99 to $49.99) and use them to send virtual gifts during Live. Tokens are a limited licence to use a feature of the Service. They:

  • have no cash value and aren’t money, property or a stored-value account;
  • can’t be sold, transferred between accounts, or exchanged for cash;
  • are non-refundable once bought, except where the law requires a refund or we choose to give one (for example, after a billing error);
  • may be lost if your account is closed or banned. Counsel to confirm: whether unused purchased tokens are refunded when a member deletes their account, and any expiry

Gifts and the host share

When you send a gift, its tokens leave your balance and can’t be taken back. The host receives 25% of the gift’s token value; TwoTide keeps the rest. Members who host receive their share as tokens, on the same terms as above. Professional hosts are paid under a separate agreement. Gifts are a way to show appreciation; they aren’t payment for any service, and no host may offer anything in exchange for gifts.

Video calls

One-to-one video calls are available on Premier and Elite. A call only starts when both people agree, and TwoTide never records calls. Don’t record anyone, on a call or on Live, without their permission.

9. Your content

You own the photos, text, messages, video and other content you post or send (“your content”). You give TwoTide a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt (for example to resize a photo), display and transmit your content, only as needed to run, secure and improve the Service. We won’t use your content in advertising or on our website without your separate consent.

The licence ends when you delete the content or your account, except for copies other members already received (like messages), backups kept for a limited time, and records we keep for safety or legal reasons as described in our Privacy Policy.

You confirm you have the right to share your content and that it follows these terms. We don’t pre-approve content, but we may review, hide or remove any content at any time.

If you believe content on TwoTide infringes your copyright, email [email protected]. Counsel to confirm: designated DMCA agent name and address, registered with the US Copyright Office, and the notice-and-counter-notice procedure

If you send us ideas or feedback, we may use them without owing you anything.

10. Our service

TwoTide, our name, logo, design, software and content (other than your content) belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the Service for its intended purpose, under these terms.

We’re always improving TwoTide, so features may change, be added or be removed. We work hard to keep it available and secure, but we can’t promise it will be uninterrupted or error-free.

11. Disclaimers and meeting safely

We verify identity; we don’t run criminal background checks. Verification tells you a real person, matching their ID, is behind a profile. It doesn’t tell you about their past, their intentions or how they’ll behave. You’re responsible for your own interactions with other members.

Before you meet someone, read our Safety center. Meet in a public place, tell a friend where you’re going, arrange your own transport, and never send money to someone you’ve met online.

Counsel to confirm: safety-awareness and background-check disclosures required of online dating services in our launch states (for example New York GBL § 394-cc and Florida’s Online Dating Safety Act), including format and placement

To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that you’ll find a match, or anything about any member.

12. Limits on our liability

To the extent the law allows, TwoTide and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service or your dealings with other members, even if we were told they were possible.

To the extent the law allows, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US $100.

Nothing in these terms limits liability that can’t be limited by law, such as for fraud, or for death or personal injury caused by our negligence where that applies. Some places don’t allow some of these limits, so they may not apply to you.

You agree to compensate TwoTide for claims, losses and reasonable legal costs that arise from your breach of these terms or your conduct towards other members, to the extent the law allows. Counsel to confirm: whether to keep this indemnity for consumer members, and the liability cap amount

13. Ending your membership

You can delete your account at any time from Settings. Deletion has a 7-day grace period in case you change your mind; after that your account is erased as described in our Privacy Policy. Deleting your account doesn’t cancel an app-store subscription; cancel that with Apple or Google too.

We may suspend or end your membership as described in Safety tools and enforcement, or if we stop offering the Service, with notice where we reasonably can.

Sections that by their nature should survive (including fees owed, your content licence for retained records, disclaimers, limits on liability and disputes) continue after your membership ends.

14. Disputes and governing law

If you have a problem with TwoTide, please email [email protected] first. Most issues can be resolved quickly and informally.

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and disputes will be heard in the state or federal courts located in New York County, New York, unless the law where you live gives you the right to bring a claim locally. Counsel to confirm: governing law and venue (New York is a placeholder); whether to require individual arbitration with a class-action waiver and an opt-out window; small-claims carve-out

15. Changes to these terms

We may update these terms as TwoTide grows or the law changes. If a change is material, we’ll tell you by email or in the app at least Counsel to confirm: 30 days before it takes effect. The date at the top of this page shows when the terms last changed. If you keep using TwoTide after a change takes effect, the new terms apply; if you don’t agree, you can cancel and delete your account.

16. Contact us

Questions about these terms: [email protected]. Legal notices: [email protected] and by post to Counsel to confirm: registered postal address for legal notices.

To report a member or a safety concern, use the report button in the app, or see the Safety center.
